Welcome to WABI. These Terms of Service ("Terms") govern your access to and use of the WABI mobile application and website (collectively, the "Service"), operated by KEPAS (Kenya Professionals in Application Solutions).

By downloading, accessing, or using WABI, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

Important: WABI is a platform that connects service seekers ("Clients") with service providers ("Workers" or "Fundis"). WABI is not a party to any service agreement between Clients and Workers.

6. Bookings, Payments, and Fees

  1. Client submits a service request with details and budget
  2. Workers receive notifications and can accept the job
  3. Client selects a Worker based on ratings, reviews, and price
  4. Both parties confirm the booking details
  5. Service is performed at the agreed time and location
  6. Payment is processed upon completion

8.1 Service Disputes

If a dispute arises between Client and Worker:

  1. Users should first attempt to resolve the issue directly
  2. If unresolved, either party may open a dispute through the app
  3. WABI will review evidence from both parties
  4. WABI will make a determination within 7 business days
  5. WABI's decision is final and binding

9. Intellectual Property

9.1 WABI Property

The Service and its content, including but not limited to text, graphics, logos, icons, images, and software, are the property of KEPAS and are protected by intellectual property laws.

By posting content on WABI, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for the purpose of operating and promoting the Service.

IN NO EVENT SHALL WABI BE LIABLE FOR:

Our total liability shall not exceed the amount of fees paid by you to WABI in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless WABI, KEPAS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WABI regarding the Service.

15.3 Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it later.

You may not assign your rights under these Terms without our prior written consent. We may assign our rights at any time without notice.
